I did wind up filing an official complaint with the Georgia Better Business Bureau.  In typical fashion, Dean never replied to the GA BBB, making my complaint official and there will be a formal complaint registered against his company for the next 3 years if anyone does a search on his company name.  Obviously this doesn’t deter him in the least but at least I get the satisfaction that I can, no matter how little or inconsequential, legally drag his name through the mud.

 

After the deadline had passed and he was notified that there was an official complaint on file, Dean finally replied via email to the person in charge of processing my complaint.  The GA BBB then notified me about it.

RE: BBB Case #20008037 - DFS Consulting, LLC

Dear Mr. Kirkpatrick:

The attached correspondence is a copy of the firm's response to your recent complaint.  We ask that you review the response as it relates to the current status of your complaint. Please notify our office in writing with any additional comments you may wish to make or disputes you may have with this response. 


Our office will close this matter and it will become a part of the company's record for a period of three years.

Please note that any additional comments you wish to make must be submitted in writing.  If you wish you can e-mail your comments directly to me at the e-mail address listed below.

Read below for Dean’s response.  I haven’t edited the nimrod’s spelling or syntax. 

 

I recently was sent case #20008037.  I am attatching a response with this
e-mail, but want you to pay close attention to the fact that DFS Consulting
was never acting as a contractor for the job.  Mr Kirkpatrick has made an
error and needs to deal with me as a person and fellow homeowner.
Thank you for your time and I apologize for this case being assigned to you
in error by the complaintant.

Company: DFS Consulting, LLC
Consumer: Mr. James Kirkpatrick
Case Number: 20008037

DFS Consulting was not hired to do the work at Keswick place town
homes or more specific James Kirkpatrick of 1335 Church Street
unit # B-3, Decatur GA 30030.  Not only is the complaint invalid
it has also made the mistake of misdirecting it towards DFS
Consulting. I Dean Solomon a homeowner at Keswick Place made a
gesture to the HOA and all the homeowners to assist in finding a
contractor and help supervise the project for FREE.  I gathered
quotes from several contractors and presented the quotes to
everyone for approval as a homeowner not a contractor.  All
participants agreed to the terms and pricing.  Mr. Kirkpatrick
wanted a better deal and I helped lower the price with Superior
Painting in order for him to join the rest of the participants.
Mr. Kirkpatrick failed to mention his unit is the largest and
most complicated unit in the complex.  He has an end unit with
double decks off the side and more doors and windows than any
other unit.  Mr. Kirkpatrick was the only person to make waves
during the entire process.  I made sure his unit was the first
one 100% complete to hopefully avoid any problems.  The only
reason checks were written to DFS consulting was to simplify
payments for the homeowners, HOA, our treasurer and contractor.
Mr. Kirkpatrick failed to mention to you that I requested a
meeting face to face in order to resole this issue.  He dismissed
my request and said he was over it and then over a month later he
posts an unsettling note on my vehicle.  Out of 17 units
participated he is the ONLY person to complain.  I have been in
business for more than eight years and have never had one
unsatisfied customer.

Since the email from the GA BBB said I could reply, of course I did.

 

Mr Solomon is correct in saying that DFS Consulting was never the "official" contractor for this job.  However, it was at his insistence that the homeowners communicate any issues via him to Superior Painting.  Since he refused to notify Superior of the issue at hand, it would have been useless to make the complaint against Superior, as I am sure they were never made aware of the issue.  Thus the complaint absolutely should be leveled against DFS Consulting and not Superior Painting.

He mentions the size and difficulty of my unit, which has nothing to do with the issue at hand, rather it's a classic contractor diversionary tactic.  The bottom line is he agreed to have my unit match the initial color it was when I bought the house and this promise was never met.

I will be more than glad to forward the entire email correspondence I had with Dean Solomon, which included his promise on several occasions that my requests would be completed, including at one point that he would do the finale request and not Superior

Perhaps, as he states he hasn't had a complaint yet, that previous clients simply haven't reported issues they have had with him.  Besides the utter disappointment of a neighbor taking advantage of another neighbor, his continued defiance and bad business practices led me to formally make this complaint.

As for his statement that we meet face to face, it's always convenient that whenever I needed to see him, he has always been "out of state".  It was only when I formally filed this complaint that I told him, via email, that I was "done with him" and I would let the GA BBB handle the complaint.

I am still perplex by Kirkfitzypatty's prolem. So I cash checks - they make out to me - should I tear up money?! No. Need gas money, Cash-now cashes check for me. STFU.


He signed this 'Regretfully'? I haven't had a complaint, Regretfully? Piece of non-work this guy...

This kirkypatty guy however, this one neighbor guy wants more than 100% - WTF to do? Screw him! yeah...I made sure his unit was the first one 100% complete to hopefully avoid any problems.

I love his response. Reveals much - which note was unsettling to him, anyway?

Ah yes, the "unsettling note" was one, where, in non-typical James-like form, I exercised some restraint. I basically said that the next day I was officially filing a report in the morning and that this is what happens when you make bad business decisions and that I was thankful that none of my other neighbors were like him. It was a Post-It note I put on his driver's side window. Since I'm positive he has my email addy blocked, I knew he didn't get my email basically saying the same thing and I wanted him to know what I was doing.

James you sure have gone through a whole lot of trouble just to brag that you have the largest unit in the whole complex.

OH MY - I am not used to spit takes at the PC! How how how, did I not notice heh unit.... ? the complicated unit -- heh hheh. I am abjectly apoplectically apologetic. Sorry.

A large unit isn't all that great unless you can paint the town white with it...
