Now that I know there isn’t a chance in hell of my paint job ever being complete, at least not through my shyster neighbor, I’ve decided to report his “business” to the Georgia Better Business Bureau.  Below is my final letter to him and I will edit this post if he replies.  Of course, when I get hoodwinked, like I did this time, my only satisfaction is now to tweak him in the only way “manly men” take offense – by calling out his manhood.  Here’s what I sent him last night.  For my contracting friends who read this, I don’t lump you in to the group I’ve listed below.

Do you want to know the best part of this whole scenario?  I get to file a report on DFS Consulting with the GA Better Business Bureau.  Whether or not they do anything is beyond my control, but I do want your unscrupulous business practices put on the official record.  People like you should not be in charge of a business.

So let's recap - the actual amount I paid was $300 more than the original estimate you gave the KPTA board (one of the units who dropped Superior wound up getting a better job for $500 less and it was done in 2 days), the finished product we agreed upon PRIOR to my payment was never complete (my stucco is NOT part of the firewall, nor is it the color it originally was), you were a 3rd party financially-involved vendor without the knowledge of most of the KTPA tenants, and then you say I should be THANKFUL and APPRECIATIVE for an unfinished product?! 

I'll be sure to copy you in on the official report with the state.  You truly made a huge mistake in not honoring your word, something only real men have.  But your attitude and incompetence is on par with most contractors.

***UPDATE***

10/11/2006 - I must have hit a nerve.  He replied with this threat.

you have nothing and I will pass this on to my attorney and we will sue for libel and slander. The job was completed 100 percent in a timely and efficient manner.  Please let's meet face to face...if you are man enough

You go, James! You're having quite a year, between contractor neighbors and moving men. This is why I never do business with friends, family and/or neighbors...and no matter what, I never pay in full until the job is done. I learned my lesson when I hired a contractor who was a friend of mine to cut some dead trees down at my old house in Tampa. I paid him on his word (after the trees were down) that he would come back and take out 3 large stumps. The fucking things are probably still there for all I know.

Never, never, never pay any money to a contractor before the work is completed and approved by you. That said, if the raw materials are expensive (think landscaping) you should pay no more than 50% prior to project completion. Any good contractor will actually insist you not pay them until the job is done. Live and learn buddy :)

Unfortunately he is two doors down from me and we do know what each other looks like. But you can be my "cousin" who is "prone" to "fits of rage".

I am pretty sure his response was a pathetic attempt at a bluff. You could always follow up his bluff with your own. Tell him that you have an old roomate from college (not that roomate) that is a lawyer. Give yourself some legitamacy and tell him he is a trial lawyer, not a civil lawyer, but he has a certain amount of pro bono work that he has to do before the end of the year because of tax reasons. He would love to put in 10 to 20 phone calls to Dean's lawyer to resolve any issues in a timely manner. As he will undoubtable know if he actual has and uses a lawyer, every call costs him at least 15 minutes at $200 to $400 per hour. I wonder how many calls it would take to eat up his portion of the profits from the paint job.

How about having Milo show up as the lawyer. That would be great!!

Idiot has no idea what they are or how to prove libel and slander. Send him a referral to some People's Lawyer advertising on TV. Libel slander Hahahahahahahaaaaaaa.

United States law dictates that for something to be considered libel it must be proven that the one making the libelous charges did so with malicious intent and with full knowledge that the statements were false. Furthermore personal opinion is protected as a First Amendment right.

He remains an idiot. try to help educate him, James!

James - I am sad to say that once again the fact that you live in GA is going to screw you out of a lot of joy. My intent was to help you yank this guy around by his short and curlies until he either gave you your money back or fixed the paint job. I was going to have you start by telling him that you have seek advice and have been instructed to request a copy of his license and his bond. This right away would have most contractors stand up and take notice. Not in good old GA. They don't require a contractors license. They will next year. I would have then guided you thru writing a formal request to initate the warranty procedure as outlined in the GA Business Code. But wait, I dd a little research of the GA Code. Unless you are buying pesticies, dairy products or cars you are screwed in GA. Several lessons learned. Trust your instincts, don't pay till the work is done, Don't live in GA.
